Statement Beyond Conviction

sergio@surgepg.orgThe story that you are about to read is hard to believe. You have to remember that it happened during a time when people were more open to communicating with the dead. During this time people believed that spirits where able to communicate with the living through dreams and appearances. This story is from beyond the realms of two different worlds and took place in San Bernardino, California. The story is about a wife that was murdered by the hands of her alcoholic husband.
In my Criminal Evidence course, I learned that in the 1880’s there was a case in which a judge allowed a statement that was made by a deceased woman to convict her husband of murder. The story goes like this: The mother of the deceased woman had a dream of her daughter trying to tell her something after she was buried. She told her husband and friends about the dreams, but at first she did not know what her daughter was trying to communicate to her.
Then one night the mother had a dream where the daughter communicated to her how she was murdered and by whom. The mother went that morning to the sheriff’s office and told her story. (note: there is more to this than just dreams) The mother told the sheriff that her daughter was choked to death by her husband. The sheriff did not believe her at first but was convinced to look into the case. The mother agreed to sign for a warrant to dig up her daughter’s body in order to find any evidence on the neck. They did find the evidence that the daughter was choked to death by someone.
That same day the husband was brought to the sheriff’s office and questioned, but could not keep his story straight. The husband claims that his wife died in her sleep next to him but he kept changing the story on how he found her dead.
When the case was brought to the courtroom; the mother was asked to take the stand and tell her story of her dreams. She stated that her daughter said to her “My husband choked me…”. This was enough for the jury to send the husband to jail for murder.
This is the only criminal case that a statement from the dead was allowed. The law changed after this. The thing that helped the conviction was that it happened in a time when people believed in spirits and souls of the loved ones communicating to them.
